Who cleans up a trauma or biohazard scene in a California home?

Short answer

Call 911 first if anyone is hurt or in danger, and wait until the responders release the scene. CSLB's classification list has no biohazard class, so ask the company what training its crew has and how it disposes of the waste. Get the contract in writing. If the job includes repairs under a home improvement contract, the down payment can be no more than $1,000 or 10 percent of the price, whichever is less.

Send the request after the scene is released

The form below takes the job and your ZIP code first and your phone number last. It costs nothing, and our referral service sends it on to one restoration company serving your ZIP code, which calls you back. Where anyone is in danger, call 911 before you open the form.

We check whether a company covers your ZIP before we ask for a phone number.

You pay nothing for this, because the restoration company that gets your request pays us. How it works

The first hour at a trauma scene

  1. If anyone is hurt or in danger, call 911 before anything else.
  2. Stay out until whoever responded says the scene is released, and keep children and pets away from it.
  3. A gas smell means leaving and calling 911, then your gas utility from outside; the numbers are in the gas note below.
  4. Leave blood and other body fluids for the cleanup crew.
  5. Phone your insurer to learn what the policy covers and what paperwork it needs. Coverage questions go to CDI's consumer line at 1-800-927-4357.
  6. Next, request a company on the form and ask about the crew's training and its handling of waste.

What CSLB's class list covers

CSLB's classification list has A, B, B-2 and C classes plus two certifications, asbestos and hazardous substance removal, and no trauma or biohazard class. The hazardous substance certification covers removal or remedial action at listed hazardous waste sites and underground storage tanks.

Ask the company in writing what training its crew has and how it handles the waste.

Sealed bag
Biohazard cleanup waits until the scene is released, and the area stays off limits while a trained crew handles it and its waste.

Contract rules when the job includes repairs

A home improvement contract must be in writing and signed before work starts, with the contractor's license number and a three-business-day notice of cancellation under B&P 7159. B&P 7159.5 caps its down payment at $1,000 or 10 percent of the contract, whichever is less, and bars payments ahead of the value of work done.

A "service and repair contract" is one of $750 or less that you started, and under B&P 7159.10 no payment is due on it until the work is completed. False or misleading advertising to win a home improvement contract is a misdemeanor under B&P 7161.

Questions to put to a company before it starts

Ask what training the crew has, how it contains and removes the waste, whether it works to a written scope, and who carries the insurance if something is damaged. If a company wants a large payment up front, the 7159.5 cap is the figure to quote back.

CSLB takes complaints against licensed and unlicensed contractors for up to four years from the act, at (800) 321-CSLB (2752). An investigation may end without restitution for you.

When a biohazard can't wait

Call right away
  • Anyone is hurt or in danger: call 911.
  • Fluids have reached a place children or pets use.
  • The scene has been released and the smell is spreading to other rooms.
Can usually wait for a normal appointment
  • A small, contained cleanup after the scene is released, once you have spoken to your insurer.
  • Repairs and repainting, after the cleanup is finished.
Gas smell: leave, then call 911 from outside, and after that your utility, either SoCalGas at 1-800-427-2200, PG&E at 1-800-743-5000 or SDG&E at 1-800-611-7343.

Who may do the repairs after a biohazard cleanup

CSLB's list names no trauma or biohazard class. The repairs afterward are contractor work, and B&P 7048 exempts a project only when it's under $1,000, casual and minor, and needs no building permit, so a bigger repair needs a contractor holding a CSLB license.

Contracting without a license is a misdemeanor under B&P 7028, with a fine of up to $5,000 on a first conviction. Look the contractor up on CSLB's license check before work starts.

Ask which licenses your state requires for the work, and check them with your state's licensing office before anyone starts. A credential from a private body, such as IICRC, isn't a license.
